EMILYs List Statement on the U.S. Supreme Court Hearing Oral Arguments for Mifepristone Case

WASHINGTON, D.C. – Tomorrow the U.S. Supreme Court will hear oral arguments in FDA v. Alliance for Hippocratic Medicine. This case uses junk science to challenge the FDA’s decades-long approval of mifepristone, a safe and effective drug used in medication abortion. This is the most consequential case for the fight to protect reproductive freedom since the Dobbs decision. A decision in this case is not expected until the summer, and until a decision is issued mifepristone will remain available. In response, EMILYs List President Jessica Mackler released the following statement: 

“It’s been less than two years since the Dobbs decision, and it’s never been more clear that Donald Trump and Republicans in office were never going to stop at overturning Roe v. Wade. They’re using the courts to push forward their unpopular anti-abortion agenda and sidestep the will of the American people. This case is yet another attempt at a back-door national abortion ban that decimates access and pushes care out of the hands of millions. 

“Trump and his Republican allies are playing politics with our bodies, lives, and futures, and it won’t stop until we stop them at the ballot box. They’ve proven time and time again that they want to be the ones making our personal medical decisions and we will not stand for that. At EMILYs List, we call on the Supreme Court to do the right thing by dismissing this case and protecting mifepristone. But in the meantime, we’ll be doing everything we can to elect Democratic pro-choice women up and down the ballot who will protect abortion access in the states and across the nation.”
